🏠 GENERAL RENTAL TERMS AND CONDITIONS (GRTC)

1. Purpose

These General Rental Terms and Conditions govern the reservation of the accommodation “La Suite Enigma,” located in La Ciotat.

Any reservation implies the tenant's full acceptance of these terms and conditions.

2. Reservation and Payment

The reservation becomes effective upon full payment.

The information provided by the tenant must be accurate.

Payment is made online by credit card via Stripe, a secure platform.

3. Security deposit

A security deposit of 200 € is required to cover any damage, vandalism, or failure to comply with the rules.

•The security deposit is not collected.

•The owner may withhold all or part of the deposit after the stay in the event of minor damage, special cleaning, or failure to comply with the house rules.

• regarding major damage (theft and breakage)

 The owner reserves the right to file a complaint with the appropriate authorities and to demand full reimbursement for the stolen item, based on its purchase price as evidenced by an invoice.

•By making a reservation, the renter expressly authorizes this potential charge.

Proof of the condition of the dwelling:

The owner records a video dated after each cleaning, before any new guest arrives, to document the initial condition of the property. This measure provides objective evidence for the move-in inspection.

Unable to process payment:

If the security deposit (or a portion thereof) cannot be charged to the provided credit card (due to an expired card, credit limit, card being blocked, or other reason), the renter will receive an email specifying the amount due.

The tenant agrees to pay this amount within 72 hours by bank transfer.

If payment is not made within this time frame, the landlord reserves the right to take any necessary legal action to obtain payment, with any resulting costs to be borne by the tenant.

If no damage is found, the security deposit is automatically released.

4. Length of stay

The tenant may not remain on the premises beyond the reserved period.

5. Capacity

Accommodations are limited to a maximum of 4 people + 1 infant.

Any overage may result in the cancellation of the stay without a refund.

6. Schedule

•Check-in: starting at 4 p.m.

•Check-out: before 12:00 p.m. (noon)

7. Cancellation Policy (Moderate – Version 1)

•Full refund up to 14 days before arrival

•Non-refundable if canceled less than 14 days in advance

8. No Right of Withdrawal

In accordance with Article L221-28 of the Consumer Code, the tenant does not have a right of withdrawal for lodging services.

9. Loyalty Program – Promo Code (10% off during the off-season)

After completing and paying for their first stay, guests receive a loyalty code offering a 10% discount on their accommodation, valid:

•October 1 through March 31 (off-season)

•on all upcoming off-season reservations

•only on the housing

This offer cannot be combined with other promotions, discounts, or codes.

10. Liability

The tenant is responsible for any damage caused during their stay.

The owner assumes no liability for loss, theft, or damage to personal property.

11. Rules of Procedure

The tenant agrees to:

•Don't host parties

•Respect the peace and quiet of the neighborhood

•No smoking indoors

•No pets allowed

Any serious violation entitles the owner to terminate the stay without a refund.

12. Tourist tax and fees

The visitor's tax is collected according to the current rate set by the municipality of La Ciotat and remitted to the municipality.

Any cleaning or laundry fees are specified at the time of booking.

13. Subletting and Visitors

Any subletting, even free of charge, is prohibited.

Visitors may not stay overnight in the accommodation without the owner's prior consent.

14. Current Status

The rental property is presumed to be in good condition and clean upon the tenant’s arrival.

Any complaints regarding the condition of the residence must be reported within 24 hours of moving in.

15. Insurance

The tenant is responsible for any damage he or she may cause to the dwelling.

He is advised to check whether his home insurance includes vacation coverage.

The owner assumes no liability for any accidents or injuries that occur in or around the rental property.

16. Force Majeure

If the property cannot be made available, the landlord shall refund all amounts paid, without any further compensation.

17. Mediation

In the event of a dispute, the renter may file a complaint with the Tourism & Travel Ombudsman (MTV):

18. Governing Law

These terms and conditions are governed by French law.

The court with jurisdiction is the one in the jurisdiction where the residence is located.

19. Acceptance of the General Rental Terms and Conditions

By confirming the reservation, the renter acknowledges that they have read and accepted without reservation these General Rental Terms and Conditions (GRTC), the house rules, and the privacy policy.

Confirmation of the reservation on the website—indicated by checking the box “I have read and accept the terms and conditions for this reservation”—constitutes an electronic signature that constitutes contractual consent within the meaning of Article 1366 of the Civil Code.
